Dear Madam:

The Women Living Under Muslim Laws (WLUML) international solidarity network is deeply concerned by the recent harassment campaign taken against Ms. Ghada Jamsheer, a woman human rights defender. Ghada Jamsheer is the president of the Women's Petition Committee, an organization which campaigns for the rights and dignity of women in the shari'ah family courts.

While Ghada Jamsheer was attending the AWID (Association for Women's Rights in Development) conference in South Africa between 14 and 17 November 2008, her home was reportedly entered by a state security agent and detailed photographs were taken. Her house phone, mobile phone, and email account are reportedly under surveillance.

Ghada Jamsheer and her family have also received threats, including many threatening text messages, and have been followed by a car. State security agents in civilian clothes have been sent to Ghada Jamsheer's house to shout at her using abusive language. She has been accused of attacking officers performing their duties and has been prevented from accessing the media. In addition, we have learned that Ms. Jamsheer’s mother and sister have had court cases brought against them, which we are concerned is directly linked to her defense of human rights.

We are concerned that the harassment campaign and the media ban against Ghada Jamsheer are directly related to her legitimate work in the defence of human rights, in particular women's rights in Bahrain, and that this may form part of an ongoing campaign against human rights defenders in the country. We are seriously concerned for the physical and psychological integrity of Ghada Jamsheer, as well as that of her family.

We urge the authorities in Bahrain to:

1. Carry out an immediate, thorough and impartial investigation into the harassment against Ghada Jamsheer and her family, with a view to publishing the results and bringing those responsible to justice in accordance with international standards ;

2. Take all necessary measures to guarantee the physical and psychological security and integrity of Ghada Jamsheer and the members of her family;

3. Guarantee in all circumstances that human rights defenders in Bahrain are able to carry out their legitimate human rights activities without fear of reprisals, and free of all restrictions including judicial harassment.

We appreciate your attention to this serious matter.

The Women Living Under Muslim Laws (WLUML) international solidarity network is deeply concerned by the recent harassment campaign taken against Ms. Ghada Jamsheer, a woman human rights defender. Ghada Jamsheer is the president of the Women's Petition Committee, an organization which campaigns for the rights and dignity of women in the shari'ah family courts.

Unlike all Bahrainis, Women of the Royal family are not prosecutedin Islamic courts in BahrainOnce again, the Bahraini Authorities deny the suffering and the rightsof women through Re-withdrawal of the Draft Family LawThe WPC Rejects the Intervention of the Royal Court to AchievePolitical Gains at the Expense of Women's RightsThe Women Petition Committee (WPC) has not been in doubt of, recent orearlier, the handling of the local Authority to the family law bill,characterized by being abusive, irresponsible and exploitive of therights of women, a cliché of public relation and show off in theinternational forums. This is not the first time, the Authorities andits breed institutions, such as the so-called Supreme Council forWomen, the Political Development Institute and others raise the sloganof the "Family Law", for the sake of promoting regime's projects atthe expense of public interest and affairs.Since the very beginning of launching its activities, the WPC realizedthe importance of introducing constraints and controlling legalizationto what has been a daily occurrence in the Islamic courts ofmanipulation of families fates, who were obligated to resort to thesecourts to end their suffering. But, to the augmented anguish of thesefamilies, their real suffering starts once their case is opened inthese courts, known of its notorious corruptive judges, who aremanipulative and poorly manage family issues, with improperconstraints.The local Authorities, lead by the Royal Court, had previously put itshands on a point of vulnerability of certain political religiousforces, and since then have been exploiting the family law issue totwist the arms of these forces, whenever needed to achieve somepolitical gains, concessions or the imposition of a particularposition by them on matters of its or public interest.On the other hand, a number of State-established and fundedinstitutions, known of its structure and allegiance, took the positionof polishing the image of the Authorities in the name of Bahrainiwomen. Everyone knows that the Supreme Council for Women (SCW) is madeup of wives of certain figures in the Royal family, members of certaintribes, and some beneficiaries of playing the sham role of loyalty.This council, made up of the Royal family women, has recently raisingthe flag of defending the family law, while its Royal members neitherattend nor being prosecuted in the Sharia courts, the rest of women inBahrain are exposed to. They Royal women are not rendered to thesuffering, humiliation and the exploitation of corrupt judges in thosecourts. They are not experiencing or enduring agony Bahraini womenbear, irrespective of flattering talk about women's rights. As for therest of SCW members, a glance look at the relationship among themwill produce blunt conclusions to the source of rising their bankaccounts, financial and other benefits coming out of the SCWprojects, "training" programs and travel expenses. These financialrewards are being exploited by the SCW elite on the expense of thebudget allocated for lifting of the suffering of Bahraini women.As for the Political Development Institute (PDI), the Bahrain Societyfor Human Rights Watch and other outputs of "Al-Bandar" gang unveiledby Dr. Salah Al-Bandar - the former adviser to the Government - in areport published in August 2006. The report clearly points out thequality of those leading and financing the Governmental institutions(GONGOS) as well as the funds and facilities provided for them tosmear human rights activists and undermine the true societalinstitutions (NGOs) advocating of real human rights values.In view of the religious structure and depth in the country, theCommittee appreciates the importance of a law in line with thereligious requirements, and not the political one, which enable theissue of the law without pitfalls and in the interest of the familyand women. Nevertheless, this concept should not be a basis to createa rift among the citizens on sectarian basis and divide the people ofthe same country. Yes, it is necessary to take into account thetheological differences, to avoid any violation to any of the existingjurisprudences, but this should not be used to introduce sectariandivisions among the people of the same country. This is very wellsensed through dubious ideas that promote the issuing the law, on thebasis of one sect, amidst the disagreement with other parties. Thesecalls are of the "Bandergate" spirit, and those behind it, provingresources for it from Riffa, are known. It aims to put pressure onwell-known religious and political forces to achieve its objectives ofdividing the society on sectarian and tribal basis.On the other hand, The WPC believes that the accord required by someparties could be fulfilled, if a "political" mandate exists, forseveral reasons among them:1 - There exist previous experiences in the Islamic world, where thereare more than one school of jurisprudence in the same country, whichcould be accessed to overcome any similar obstacles. Bahrain is notonly country in the Islamic world facing the subject of codificationof personal status, and the fact that there are more than one theologyshould not be taken as an excuse.2 – Numerous legislative and legal experiences are accessible in thecountry, who can offer a real point of reference for any area ofprimary difference in the drafting of this law. It is not acceptableto leave this law subjective to the ideological and politicalenticements, at present or future.The Committee believes the danger of manipulation and tampering withan inherent right of woman, and the need for protected rights –fromreligious, legal and family perspective – for her, her birth and herfamily. The Committee, therefore, calls for the following:1) The Royal Court should refrain from the abusive interference andmanipulation of the draft family law for political agenda, on theexpense of women and its human rights. The WPC envisages that the talkabout the enactment of the Law of the Sunni sect and another for theShiite community is an output of the locally dubbed "Al-Bandergate"secret organization led by Khalid Bin Ahmed Al-Khalifa- Royal Court Minister- inorder to introduce sectarian sedition and further divide the societyon sectarian basis.2) The royal Supreme Council for Women (SCW) should stop talking aboutBahraini women and cease its allegation to defend her rights. SCW isan elite institution composed of members of the royal family and thosebenefiting from its financial rewards and propaganda.3) In a blink of an eye, the local Authority was able, on its own, toabolish a contractual constitution with the people of Bahrain, andunilaterally impose its own constitution, must be capable and obligedto provide the required guarantees possible for this law to berealized in the interest of the family of Bahrain.4) The independence of the judiciary, reform of the Sharia courts andthe provision of a powerful regulatory mechanism to intervene in theselection of judges, hold them accountable, and subject them to thenecessary training and rehabilitation programs to learn the family lawprovisions and its implementations.5) Reform the control and judicial enforcement apparatus to ensure itsindependence of any intervention by individuals and institutions -regardless of their position and status, comply with the judiciaryprovisions and controls, and the swift implementation of theprosecutions to alleviate the suffering of women and their children.6) Expedite the issuance of the Family Law to protect women from thepersistent violations, suffering and the loss of rights, as well asnot to subject the bill to any political enticements, or be used as atool to wedge differences among the citizens of the same country andtear out relations between
members of the same family.

مرة بعد أخرى، السلطات البحرينية تتنكر لمعاناة المرأة وحقوقها من خلال تقديم ثم سحب مشروع قانون الأسرة

لم تكن لجنة العريضة النسائية في شك في كيفية تعاطي السلطة الأخير أو قبله مع مشروع قانون الأسرة من قمة اللامسئولية والتلاعب بحقوق المرأة التي طالما تشدقت بها على المنابر الدولية. فهذه ليست المرأة الأولى التي يرفع فيها شعار "قانون الآسرة" سواء من خلال مؤسسات الديوان، مثل ما يسمى بالمجلس الأعلى للمرأة أو معهد التنمية السياسية أو غيرها من مخرجات مشاريع الترويج للنظام على حساب الصالح العام وشئونه.
فمنذ الوهلة الأولى التي دشنت فيها لجنة العريضة النسائية أنشطتها، تبين أهمية المطالبة بضرورة وجود سيطرة وتقنين لما يحدث في المحاكم الشرعية من تلاعب بمصير الأسر التي تضطر للجوء لها لإنهاء معاناتها، إلا إن الأسر تبدأ معاناتها الحقيقية منذ أن يفتح ملفها لدى تلك المحاكم التي اشتهرت بفساد قضاتها وتلاعبهم وسوء إدارتهم لقضايا الأسرة.
لقد وقعت السلطة- وفي مقدمتها الديوان الملكي - على نقطة ضعف بعض القوى السياسية المحسوبة على القطاع الديني، وظلت تستغل ملف الأسرة للي ذراع تلك القوى كلما آن الأوان لتحقيق بعض التنازلات او المكتسبات السياسية أو فرض تعاطي معين من قبل تلك القوى لبعض الملفات ذات الإهتمام الشعبي أو إهتمام السلطة.
من جانب آخر، فقد انبرت عدة مؤسسات معروفة التركيبة والتوجه في محاولة المشاركة في تلميع صورة السلطة باستعمال اسم المرأة البحرينية. فالجميع يعرف أن المجلس الأعلى للمرأة هو مجلس مكون من نساء أشخاص محددين في العائلة الملكية، وبعض أفراد القبائل، وبعض المنتفعات والمستفيدات من لعب دور إظهار الولاء المزيف. فهذا المجلس المكون من نساء العائلة الملكية صار مؤخراً يتحدث عن قانون الأسرة، ونساء العائلة الملكية لا يحاكمون في المحاكم الشرعية التي يتحاكم فيها بقية نساء البحرين، ولايتعرضن للمعاناة والمهانة واستغلال القضاة الفاسدين في تلك المحاكم. ولهذا فهن لا يتعرضن لما تتعرض له وتقاسيه المرأة البحرينية، مهما تشدقن بالحديث والكلام. أما عن البقية من أفراده، فنظرة بسيطة لخارطة النسب والعلاقة بينهن، يتضح للعلن الدور التطفلي والنفعي الذي تتخم فيه أرصدتهن البنكية من المشاريع والبرامج "التدريبية" ونفقات السفر التي يستفدن منها على حساب الميزانية المخصصة لرفع معاناة المرأة البحرينية.
وأما معهد التنمية السياسية وجمعية البحرين لمراقبة حقوق الإنسان وغيرها من مخرجات مخطط العصابة البندرية التي كشف عنها الدكتور صلاح البندر – مستشار الحكومة السابق في تقريره الأول الصادر في أغسطس 2006م، والتي أوضح نوعية من يقود ويمول تلك الجمعيات الحكومية (الغونغو) وما يستلموه من أموال وتسهيلات – هي أموال للشعب- يتلاعبوا فيها ويسخروا قدراتهم وجهودهم للنيل من النشطاء والمؤسسات المجتمعية الحقيقية المدافعة عن الحقوق.
ونظراً للتركيبة والعمق الديني في البلد، فإن اللجنة تقدر أهمية أن يصدر ذلك القانون بالتوافق مع المتطلبات الشرعية، وليس السياسية، التي تمكنه من السير دون عثرات تحسب على مصلحة الأسرة والمرأة، على أن لا يتم الإستناد على هذا المفهوم لخلق شرخ بين أبناء البلد على أساس طائفي وتفريق بين أبناء الوطن الواحد. نعم، لابد من مراعاة الفوارق الشرعية بما يتلائم عدم انتهاك لأي خصوصية لأي من المذاهب، إلا إن ذلك لايستوجب خلق جدار بين أبناء البلد وتكريس النفس والتقسيم الطائفي بينهم من خلال الأفكار المريبة التي تشجع على استصدار قانون بصيغة مذهبية معينة وتمريره ما دام هناك عدم توافق مع بعض الأطراف. إن هذه الدعوات، ذات نفس بندري معروف من يقف وراءها ويمدها بالخيل والرجال في الرفاع، وتهدف للضغط على قوى دينية وسياسية ومعروفة، وتحقيق مبتغاها في تقسيم المجتمع على أساس قبلي ومذهبي.
من جانب آخر، فإن التوافق الذي تطالب به بعض الجهات هو أمر قابل للتحقق إذا ما توفرت الإرادة "السياسية" المطلوبة لذلك، لعدة أسباب أهمها:
1- بأن هناك تجارب أخرى سابقة موجودة في العالم الإسلامي حيث وجود أكثر من مدرسة فقهية للأحكام الشرعية في نفس تلك البلدان، ويمكن الاستفادة والاستعانة بتلك التجارب، والتغلب على أي عوائق مشابهة، دون التحجج بأي ذريعة، فليست البحرين الوحيدة في العالم الإسلامي طرح فيها موضوع تقنين الأحوال الشخصية.
2- هناك في البلد من الخبرات التشريعية والقانونية ذات التمكن الشرعي والديني ما يمكن أن يوفر مرجعاً حقيقياً لأي مساحة اختلاف ابتدائية في صياغة هذا القانون الذي لا يمكن أن يقبل اخضاعه للتجاذبات والأمزجة الايديولوجية والسياسية حاضراًَ أو مستقبلاً.
وتعتقد اللجنة بخطورة التلاعب والعبث بحق أصيل للمرأة المتمثل في وجود ما يحمي حقوقها- الشرعية والقانونية والأسرية- وحقوق أبناءها وعائلتها. وتطالب اللجنة بما يلي:
1) أن يتوقف الديوان الملكي من استعمال مشروع قانون الأسرة كورقة سياسية على حساب المرأة وحقوقها الإنسانية والشرعية، وأن يرفع يده من توجيه القانون والتدخل في مخرجاته. إن الحديث عن إصدار قانون للطائفة السنية وآخر للطائفة الشيعية هو أحد مخرجات المخطط البندري الذي يقوده وزير الديوان ذو الحس الطائفي المرهف – خالد بن أحمد آل خليفه - لتشطير المجتمع وتقسيمه على أسس طائفي ومذهبي.
2) أن يتوقف المجلس الملكي (المجلس الأعلى للمرأة) عن الحديث عن المرأة البحرينية والإدعاء بالدفاع عنها، فهو مجلس نخبة يتمثل بأفراد من العائلة الملكية والمنتفعات من ريعه وبرامجه الدعائية.
3) أن السلطة التي استطاعت لوحدها أن تلغي دستوراً عقدياً مع شعب البحرين في غمضة عين وفرض دستورها بإرادة منفردة، قادرة وملزمة بتوفير الضمانات الممكنة والمطلوبة لأن يرى هذا القانون النور لما فيه مصلحة الأسرة البحرينية.
4) ضمان استقلالية القضاء وإصلاح المحاكم الشرعية وتوفير آلية محكمة ذات صلاحيات رقابية تتدخل في اختيار ومحاسبة القضاة الذين لابد أن يتصفوا بالشرف والأمانة ابتداءاَ، واخضاعهم للتدريب والتأهيل بشكل كاف وقدير بما يضمن تمكنهم من الأحكام وتنفيذها.
5) إصلاح جهاز الضبط والتنفيذ القضائي وضمان استقلاليته من تدخل الأفراد والمؤسسات- مهما كان موقعها أو يديرها- في الألتزام بالاحكام والضوابط القضائية والسرعة في تنفيذها لرفع الضرر الواقع على المرأة وأبناءها.
6) الاسراع في اصدار قانون للأسرة لحماية المرأة من الإنتهاكات المستمرة ومعاناتها وضياع حقوقها، وعدم إخضاعه للتجاذبات السياسية، وأن لا يستعمل أداة تدق إسفين الفرقة بين أبناء الوطن الواحد وتمزيق الأسرة البحرينية الواحدة.

ونظراً للتركيبة والعمق الديني في البلد، فإن اللجنة تقدر أهمية أن يصدر ذلك القانون بالتوافق مع المتطلبات الشرعية، وليس السياسية، التي تمكنه من السير دون عثرات تحسب على مصلحة الأسرة والمرأة، على أن لا يتم الإستناد على هذا المفهوم لخلق شرخ بين أبناء البلد على أساس طائفي وتفريق بين أبناء الوطن الواحد. نعم، لابد من مراعاة الفوارق الشرعية بما يتلائم عدم انتهاك لأي خصوصية لأي من المذاهب، إلا إن ذلك لايستوجب خلق جدار بين أبناء البلد وتكريس النفس والتقسيم الطائفي بينهم من خلال الأفكار المريبة التي تشجع على استصدار قانون بصيغة مذهبية معينة وتمريره ما دام هناك عدم توافق مع بعض الأطراف. إن هذه الدعوات، ذات نفس بندري معروف من يقف وراءها ويمدها بالخيل والرجال في الرفاع، وتهدف للضغط على قوى دينية وسياسية ومعروفة، وتحقيق مبتغاها في تقسيم المجتمع على أساس قبلي ومذهبي.
من جانب آخر، فإن التوافق الذي تطالب به بعض الجهات هو أمر قابل للتحقق إذا ما توفرت الإرادة "السياسية" المطلوبة لذلك، لعدة أسباب أهمها:
1- بأن هناك تجارب أخرى سابقة موجودة في العالم الإسلامي حيث وجود أكثر من مدرسة فقهية للأحكام الشرعية في نفس تلك البلدان، ويمكن الاستفادة والاستعانة بتلك التجارب، والتغلب على أي عوائق مشابهة، دون التحجج بأي ذريعة، فليست البحرين الوحيدة في العالم الإسلامي طرح فيها موضوع تقنين الأحوال الشخصية.
2- هناك في البلد من الخبرات التشريعية والقانونية ذات التمكن الشرعي والديني ما يمكن أن يوفر مرجعاً حقيقياً لأي مساحة اختلاف ابتدائية في صياغة هذا القانون الذي لا يمكن أن يقبل اخضاعه للتجاذبات والأمزجة الايديولوجية والسياسية حاضراًَ أو مستقبلاً.
وتعتقد اللجنة بخطورة التلاعب والعبث بحق أصيل للمرأة المتمثل في وجود ما يحمي حقوقها- الشرعية والقانونية والأسرية- وحقوق أبناءها وعائلتها. وتطالب اللجنة بما يلي:
1) أن يتوقف الديوان الملكي من استعمال مشروع قانون الأسرة كورقة سياسية على حساب المرأة وحقوقها الإنسانية والشرعية، وأن يرفع يده من توجيه القانون والتدخل في مخرجاته. إن الحديث عن إصدار قانون للطائفة السنية وآخر للطائفة الشيعية هو أحد مخرجات المخطط البندري الذي يقوده وزير الديوان ذو الحس الطائفي المرهف – خالد بن أحمد آل خليفه - لتشطير المجتمع وتقسيمه على أسس طائفي ومذهبي.
2) أن يتوقف المجلس الملكي (المجلس الأعلى للمرأة) عن الحديث عن المرأة البحرينية والإدعاء بالدفاع عنها، فهو مجلس نخبة يتمثل بأفراد من العائلة الملكية والمنتفعات من ريعه وبرامجه الدعائية.
3) أن السلطة التي استطاعت لوحدها أن تلغي دستوراً عقدياً مع شعب البحرين في غمضة عين وفرض دستورها بإرادة منفردة، قادرة وملزمة بتوفير الضمانات الممكنة والمطلوبة لأن يرى هذا القانون النور لما فيه مصلحة الأسرة البحرينية.
4) ضمان استقلالية القضاء وإصلاح المحاكم الشرعية وتوفير آلية محكمة ذات صلاحيات رقابية تتدخل في اختيار ومحاسبة القضاة الذين لابد أن يتصفوا بالشرف والأمانة ابتداءاَ، واخضاعهم للتدريب والتأهيل بشكل كاف وقدير بما يضمن تمكنهم من الأحكام وتنفيذها.
5) إصلاح جهاز الضبط والتنفيذ القضائي وضمان استقلاليته من تدخل الأفراد والمؤسسات- مهما كان موقعها أو يديرها- في الألتزام بالاحكام والضوابط القضائية والسرعة في تنفيذها لرفع الضرر الواقع على المرأة وأبناءها.
6) الاسراع في اصدار قانون للأسرة لحماية المرأة من الإنتهاكات المستمرة ومعاناتها وضياع حقوقها، وعدم إخضاعه للتجاذبات السياسية، وأن لا يستعمل أداة تدق إسفين الفرقة بين أبناء الوطن الواحد وتمزيق الأسرة البحرينية الواحدة.

As you know that I was always subjected to different kinds of harassments, such as close monitoring of my house by security bodies in plain clothes standing out of the house most of the time, as well as attempt to fix camera and wiring my house, and banning me from publishing in local newspapers, and Filing more than 20 falls criminal and civil cases that was presented before court against me, and now again breaking into my house for videoing and picturing while I was abroad.

On November 18, 2008, the security body instructed a female of Egyptian nationality (W. S.) to enter my house, taking advantage of my time in South Africa, under the pretext of carrying out the work of decoration that I have asked her to do, which is not at all true.

She filmed and pictured inside and outside the house, including bedrooms, bathrooms , wardrobes and every corner of the house.

My family members tried to stop her from continuing doing so, and they tried to remove the memory chip from her camera, but they failed. Then they called the police later. My family filed a complaint against her for entering the house without the knowledge of its owner, and filming without permission from me. complaint number is 2028-2008.
The police of Budaya Station refused to ask her for the memory chip that have the film and photos and instead help her to hide them. Public Prosecutor also refuse to activated the case tell today, and I believe it is an order from the National Security Apparatus.

These shameful actions has violated my rights to privacy and security’ which I am afraid that is a plan to make a something towards damaging my images and repetition in society, taking advantage of those photo and film.

I strongly belief that the National Security Apparatus and the Royal Divan, are behind this action as a result of my fight for the women rights and human Rights.

Therefore, I request you as an honorable institution and respected international organizations to do what is appropriate for you to stop the National Security Apparatus and the royal court of harassing and targeting me.

Front Line is deeply concerned following information received regarding an alleged harassment campaign against Ghada Jamsheer, a woman human rights defender. Ghada Jamsheer is the president of the Women's Petition Committee, an organisation which campaigns for the rights and dignity of women in the shari'ah family courts.
While Ghada Jamsheer was attending the AWID (Association for Women's Rights in Development) conference in South Africa between 14 and 17 November 2008, her home was reportedly entered by a state security agent and detailed photographs were taken. Her house phone, mobile phone, and email account are reportedly under surveillance and received many threatening SMS.Ghada Jamsheer and her family have also been threatened and followed in a car, while members of security in civilian clothes have been sent to her house to shout at her with abusive language.
Finally, she has been accused of attacking officers performing their duties and has been prevented from accessing the media.Front Line is concerned that the harassment campaign and the media ban on Ms. Ghada Jamsheer is directly related to her legitimate work in defence of human rights, in particular women's rights in Bahrain, and that it may form part of an ongoing campaign against human rights defenders in the country. Front Line is seriously concerned for the physical and psychological integrity of Ghada Jamsheer, as well as that of her family.
Front Line urges the authorities in Bahrain to:
1.
Carry out an immediate, thorough and impartial investigation into the harassment against Ghada Jamsheer and her family, with a view to publishing the results and bringing those responsible to justice in accordance with international standards ;
2.
Take all necessary measures to guarantee the physical and psychological security and integrity of Ghada Jamsheer and the members of her family;
3. Guarantee in all circumstances that human rights defenders in Bahrain are able to carry out their legitimate human rights activities without fear of reprisals, and free of all restrictions including judicial harassment.
Front Line respectfully reminds you that the United Nations Declaration on the Right and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms, adopted by consensus by the UN General Assembly on 9 December 1998, recognises the legitimacy of the activities of human rights defenders, their right to freedom of association and to carry out their activities without fear of reprisals. We would particularly draw your attention to Article 9 (3-c):
“everyone has the right, individually and in association with others, /inter alia: (/c) To offer and provide professionally qualified legal assistance or other relevant advice and assistance in defending human rights and fundamental freedoms”, and to Article 12 (1 and 2): “(1) Everyone has the right, individually and in association with others, to participate in peaceful activities against violations of human rights and fundamental freedoms; (2) The State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threat, retaliation, de facto or /de jure/ adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration.”

AN international human rights organisation is calling on the Bahrain government to investigate claims that activist Ghada Jamsheer is being harassed by state security forces. Front Line, which works to protect human rights defenders at risk, said after carrying out its own investigation it had become deeply concerned over an alleged harassment campaign against the Bahraini women's rights activist.The Dublin-based organisation says the Women's Petition Committee president is reportedly under surveillance by state security.It is alleged that security officials entered her home while she was out of the country from November 14 to 17 last year and took photographs - though it could not provide evidence of this, when asked by the GDN.Security forces are reportedly carrying out surveillance on Ms Jamsheer's house phone, mobile phone and email account and she has apparently received many threatening SMS messages, says Front Line.Ms Jamsheer and her family have allegedly been threatened and followed in a car and men in civilian clothes have gone to her house and shouted abuses at her.She has also reportedly been accused of attacking officers performing duties and has been prevented from accessing the media."Front Line is concerned that the harassment campaign and the media ban on Ms Jamsheer is directly related to her legitimate work in defence of human rights, in particular women's rights in Bahrain and that it may form part of an ongoing campaign against human rights defenders in the country," states a Front Line Press release. "She is not acting on behalf of any political party - she is defending women's rights. I believe we have an obligation to support her."Mr Ibrahim said especially now that Bahrain was a member of the United Nations Human Rights Commission, it was important it showed evidence of supporting human rights.He called on the government to form a committee to investigate the allegations and to publish results."She (Ms Jamsheer) is a peaceful woman and she is not allowed to write to the media and this is against freedom of expression. الموضوع : شكوى بشأن أقتحام جهاز الأمن الوطني لمنزلي أثناء غيابي في الخارج

. لقد تعرضت في مرات سابقة لمضايقات عديدة منها، على سبيل المثال لا الحصر، المراقبة اللصيقة لمنزلي من قبل عناصر جهاز الأمن بلباس مدني ، محاولة زرع أجهزة تنصت في منزلي، منعي من النشر في الصحافة المحلية والتواصل الاعلامي الداخلي، فبركة قضايا جنائية وتقديمي لمحاكمات عدة وأخيرا اقتحام منزلي من قبل جهاز الأمن الوطني أثناء غيابي لحظور مؤتمر بجنوب أفريقيا .فبتاريخ 18 نوفمبر2008م، أوعز جهاز الأمن لسيدة مصرية الجنسية (و. ص.) خبيرة ديكور لتقوم بدخول منزلي مستغلين ظرف سفري الى جنوب أفريقيا لحظور مؤتمر أود لحقوق المرأة. وبحجة القيام بأعمال الديكور مدعيه أني قد سمحت لها بذلك، وهو أمر لم يتم على الأطلاق وغير منطقي، قامت تلك المدعوة بتصوير المسكن من الداخل والخارج، كما قامت بتصوير غرف النوم ودورات المياه وخزائن الملابس وكل ركن من أركان المنزل.
لقد تصدت أسرتي لتصرفات عميلة جهاز الأمن الوطني فقامت بالاتصال بالشرطة كما حاولت نزع قرص الذاكرة الموجود بالكاميرا، إلا أنها بائت بالفشل. كما قامت أسرتي بتقديم بلاغ ضد تلك السيدة لدخول منزل دون علم صاحبته، والقيام بالتصوير دون إذن مني (شكوى رقم 2028-2008).
فبسبب تواطؤ أفراد شرطة مركز البديع مع تلك العميلة، وخصوصاً الشرطية (فاطمة النمشان) التي قامت بمساعدتها في إخفاء وتهريب قرص ذاكرة الكاميرا أثناء تواجد الجميع بالمركز. كما رفض الفريق المناوب في الشرطة طلب تفتيش العميلة وتسليم الذاكرة، مما يدلل على وجود تعاون بين أكثر من جهاز أمني في القضية.
إني أشك في ان السبب في عدم تحريك النيابة العامة للشكوى المشار لها آنفاً هو خضوع لتعليمات جهاز الأمن الوطني. بل أني أعتقد بإن العكس هو الذي سيحدث، وهو تحريك دعوى ضدي - مثلا بادعاء الإعتداء على موظف أثناء تأدية وظيفته أو أي مسمى آخر- لمقايضتي في قبال جريمة التجسس التي قام بها جهاز الأمن الوطني.
وأعتقد بأن العمل المشين والمنتهك للحرية الشخصية الذي نفذه جهاز الأمن الوطني يقصد الى إحداث الرعب النفسي لما قد يقوم به ذلك الجهاز من فبركة صور من شأنها الأضرار بسمعتي كناشطة بأي وسيلة، مستفيداً من التقرير المصور لزوايا وممرات وغرف المنزل، ربما باستعمال تقنيات التصوير الحديثة.

أني احمل جهاز الأمن الوطني والديوان الملكي المسئولية الكاملة لأي تداعي أو مترتبات اختراق خصوصياتي. لذلك أتقدم الى كافة الشرفاء ومؤسسات المجتمع المدني إوالمنظمات الدولية باعلان موقفهم والقيام بما هو مناسب تجاه ما قام به جهاز الأمن الوطني كما أطالب المجتمع الدولي والمنظمات الدولية بالضغط على الديوان الملكي وجهاز الأمن الوطني للتوقف عن محاولات المضايقة والتحرش بي .
